What You Need to Prove to Win a Personal Injury Case
In order to win a personal injury case, there are four elements that you’ll need to establish by a preponderance of the evidence. These include:
- The defendant owed you a duty of care. In most cases, duty of care is implied and will not need to be argued. In some cases, however, duty of care may be less clear. For example, whether a property owner owed someone on their property a duty of care depends on whether the plaintiff was on the property lawfully or not.
- The defendant breached the duty of care. The second thing that a plaintiff has to prove in a personal injury case is that the defendant breached the duty of care owed to the plaintiff. This is usually done as a result of negligence. Examples of negligence might include drunk driving, failing to repair a hazardous condition on a property, or driving at an unsafe speed.
- The breach of the duty of care was the proximate cause of the accident/injuries. One of the most important elements that a plaintiff has to prove is that of causation – that the accident would not have occurred but for the defendant’s negligence.
- Damages. Finally, in order to recover compensation, a plaintiff must prove that they have stuffed actual damages, either economic, noneconomic, or both.
